These terms apply to anyone who uses the Journi Website. Please read these terms before using the Website. If you have any questions about these terms, please contact us. Our contact details are on the Website. If you do not agree with these terms, please do not use the Website. If you use the Website, that means you agree to these terms.
We may change these terms at any time. We will notify you if there are significant changes that effect you. We last updated these terms on 28 March 2018.
Below is a list of defined terms that we use in these terms:
"Journi" means the online interactive educational road safety program provided through the Website.
"Student" means a person who signs up to use Journi as a student.
"Teacher" means a person who signs up to use Journi as a teacher.
"we", "us" and "our" means the State of Queensland, Department of Transport and Main Roads.
"Website" means the website at journi.tmr.qld.gov.au. The Website includes Journi.
"you" means a person who uses the Website.
Registration
You will need to register and create an account before you can use Journi.
You can register as a Teacher by completing the registration process on the Website. You will only be able to register as a Teacher if you have an email address that ends with a domain that we recognise as being associated with an educational institution, such as eq.qld.au, det.qld.gov.au or edu.au.
A Teacher can create a class and invite their students to register. A Teacher should obtain parental consent before inviting students to register and use Journi.
You can register as a Student using the link sent to you by your Teacher, and then completing the registration process on the Website.
If you are under the age of 18, you need to make sure your parent or guardian reads these terms and agrees to them before you register.
When you register you will be asked to choose a password. You must keep your password secret. You should change your password if you are concerned it may be known to others. If you are a Student, you will need to ask your Teacher to change your password for you. You are responsible for all use of Journi made by anyone who uses your password, whether authorised by you or not.
Using Journi
Journi is an online interactive educational program program that provides road safety information for school students in Queensland. Journi is free to use.
We want to you to have fun using Journi. You must not use Journi in a way that would offend or upset anyone, interferes with anyone else's use of Journi, or which would be harmful to our interests.
User Content
Journi may allow you to enter, create or upload text, images or other content (User Content).
You must ensure User Content:
is not offensive, defamatory, illegal or otherwise inappropriate;
does not contain another person's personal information, unless you have their express consent to include it; or
does not infringe another person's rights.
You give us a perpetual, irrevocable, worldwide, royalty-free, sub-licensable license to exercise intellectual property rights in User Content to provide and operate the Website. If you have any moral rights in User Content, you consent to us doing any act or omission in respect of User Content that would otherwise infringe your moral rights.
We may remove or edit any User Content that does not comply with these terms.
Journi coins
You can earn Journi coins by completing activities and games in Journi. Your Teacher may also award you with Journi coins.
Journi coins can only be used to buy rewards within Journi. They have no other value and are not redeemable for cash. You must not sell or trade Journi coins.
Any unused Journi coins will expire when your account is closed.
Closing your account
Your account will automatically close at the end of the calendar year in which you register.
We may close your account immediately if:
you are a Student and your Teacher asks us to close it;
you are a Teacher and you or your school ask us to close your account; or
you breach these terms.
We may also close your account by giving you reasonable notice.
When your account is closed, any information you have provided to us and our record of your progress in Journi is deleted.
Intellectual property
Intellectual property rights in the Website (including Journi and all content on the Website) belong to us and our licensors. With the exception of content specifically licensed on other terms, you may use the Website only for educational, non-commercial use and you must not:
resell, redistribute or otherwise make any commercial use of the Website;
download or copy the Website, except as may occur during the normal operation of your computer or device;
modify the Website;
create any work that embodies any part of the Website; or
frame any part of the Website (for clarity, this includes embedding part of or all of the Website in another webpage or browser that is independent to the Website).
If you give us any feedback, suggestions or ideas about the Website, they belong to us and we may use them without accounting to you.
Security
We do not accept responsibility for loss or damage to computer systems arising in connection with use of the Website. You should take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to the risk of viruses, malicious computer code or other forms of interference.
Trade marks
Our trade marks may not be used except as expressly permitted by these terms or otherwise with prior written permission from the trade mark owner.
Privacy
You consent to your personal information being collected, used, disclosed and otherwise handled in accordance with our Privacy Statement. If you are a recipient of personal information in connection with the Website, you must comply with our Privacy Statement in the handling of this information. Our Privacy Statement is available on the Website.

We make no representation or warranty regarding the content of those sites, and no responsibility is taken for the consequences of viewing and relying on any content on those sites. Provision of these links does not constitute endorsement or support by us for the information, products, services or persons associated with third party sites.
Disclaimer and liability
The materials on the Website are provided as an information source only. We make no statements, representations or warranties about the accuracy or completeness of, and you should not rely on, any information contained on the Website. We also do not represent or warrant that the Website will be error free or continuously available.
To the extent permitted by law, our liability for breach of these terms, or in tort (including negligence) or for any other common law or statutory cause of action:
is limited to $100; and
excludes any loss or damage which is incidental, consequential, special, exemplary, punitive or indirect.
To the extent permitted by law, any term, condition or warranty which would otherwise be implied into this agreement is excluded. Where a consumer guarantee or term implied by law cannot be excluded, our aggregate liability for any breach of the guarantee or term is limited at its option to supplying the Website to the you again.
Indemnities
You indemnify and defend us and our officers, employees, agents and contractors ("those indemnified") against claims, liabilities, losses, damages, costs and other expenses made against, or suffered or incurred by those indemnified as a result of:
your use of the Website; or
a breach of these terms, or negligence relevant to the Website, by you.

We will not be liable for any delay or failure to perform where such delay or failure was caused by circumstances beyond our reasonable control.

You cannot transfer or assign your responsibility for, or your rights under, these terms without our prior written consent. We can transfer or assign our responsibility for, or our rights under, these terms at any time to any person without telling you.
When we are required by law to give information to you, you consent to that information being given by an electronic communication. We are not required to provide an unsubscribe facility in electronic communications we send to you.
The laws of Queensland, Australia govern these terms. You submit to the non-exclusive jurisdiction of the courts of Queensland, Australia in any action or legal process concerning these terms.
In these terms, headings are for convenience only and do not affect interpretation, and unless the context requires otherwise:
a reference to a document (including these terms of use) is to that document as varied, novated, ratified or replaced from time to time;
"person" includes an individual, the estate of an individual, a corporation, an authority, an association or a joint venture (whether incorporated or unincorporated), a partnership and a trust;
a word importing the singular includes the plural (and vice versa;
if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;
"includes" in any form is not a word of limitation.
